Your use of our Services is subject to these Terms, which constitute a legally binding agreement between you and TPH Business Consultancy Services.

Certain features or services may be subject to additional terms and conditions, which will be presented to you at the time of use. Such additional terms are incorporated by reference into these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Services. Your continued use after changes constitutes acceptance of the modified Terms.

You must be at least 18 years old to create an account and use our Services. By using our Services, you represent and warrant that you are at least 18 years of age.

If you are under 18 years of age, you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

You represent that you have the legal capacity to enter into a binding agreement with us and are not barred from using our Services under any applicable laws.

Our Services are intended for users worldwide. However, we make no representations that the Services are appropriate or available for use in all locations.

To access certain features of our Services, you must create an account by providing accurate and complete information, including your name, email address, and birth information (date, time, and location) for Human Design chart calculations.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Create a strong, unique password
• Not share your account credentials with others
• Notify us immediately of any unauthorized access
• Log out of your account at the end of each session

You agree to keep your account information accurate and up-to-date. Inaccurate birth information may result in incorrect Human Design chart calculations.

Each person may maintain only one account. Creating multiple accounts may result in termination of all accounts.

We provide free and premium Human Design chart calculations based on your birth information. Charts are generated using established Human Design calculation methods.

We offer courses, classes, and educational materials about Human Design, including our signature 44-week deconditioning journey program.

Our platform includes AI chat functionality to help you understand your Human Design. AI responses are for educational purposes only and should not replace professional advice.

We provide internal social media and community features where users can share insights, experiences, and content related to Human Design.

We strive to maintain continuous availability of our Services but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature at any time.

We offer certain Services free of charge, including basic chart generation and limited educational content. Free Services may be modified or discontinued at any time.

Premium features, courses, and additional services require payment. We offer:

• One-time purchases: Single payments for specific courses, readings, or digital products
• Subscription plans: Recurring payments for ongoing access to premium features
• In-app purchases: Additional content or features available within the platform

All payments are processed through our third-party payment providers. By making a purchase, you agree to their terms of service.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

Due to the digital nature of our Services:

• Digital products and downloaded content are generally non-refundable
• Subscription refunds may be granted within 7 days of initial purchase if no premium content has been accessed
• Course refunds may be available within 14 days if less than 20% of content has been accessed
• Technical issues preventing access will be resolved or refunded

We reserve the right to modify prices for our Services. Existing subscribers will be notified of price changes at least 30 days before they take effect.

Prices may be exclusive of applicable taxes. You are responsible for paying any applicable sales tax, VAT, or other taxes required by your jurisdiction.

"User Content" includes all content, materials, information, and data that you upload, post, submit, or transmit through our Services, including but not limited to:

• Messages in AI chat conversations
• Posts, comments, and interactions in community features
• Profile information and images
• Testimonials and reviews
• Any other content submitted to our platform

You retain ownership of your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and create derivative works of your User Content for the purpose of operating and improving our Services.

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with these Terms and applicable laws

We reserve the right to review, monitor, and remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

Content submitted through our AI chat features may be used to improve our Services and AI capabilities. We may retain and analyze chat conversations for service improvement purposes.

The following are the exclusive property of TPH Business Consultancy Services and are protected by intellectual property laws:

• Total Human Design name, logo, and branding
• Website and application design, layout, and visual elements
• Trademarks, service marks, and trade dress
• Original educational content and course materials
• Software, code, and technical systems
• Proprietary methodologies and interpretations

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without written authorization
• Reverse engineer, decompile, or disassemble our software
• Create derivative works based on our Services
• Use our content for commercial purposes without a license
• Remove or alter any proprietary notices

The Human Design System was created by Ra Uru Hu. We respect the intellectual property rights associated with the original teachings while providing our own unique interpretations and educational materials.

• Violate any applicable laws or regulations
• Engage in fraudulent, deceptive, or misleading activities
• Infringe upon intellectual property rights

• Post content that is defamatory, obscene, or offensive
• Harass, threaten, or intimidate other users
• Post false or misleading information
• Share personal information of others without consent

• Attempt to gain unauthorized access to our systems
• Introduce viruses, malware, or harmful code
• Interfere with the proper functioning of our Services
• Use automated systems to scrape or collect data
• Bypass security measures or access controls

• Resell or redistribute our Services without authorization
• Use our Services for competitive purposes
• Collect user information for marketing purposes

• Impersonate any person or entity
• Falsely claim affiliation with our company
• Create misleading accounts or content

If you provide us with any feedback, suggestions, ideas, improvements, or other input regarding our Services ("Feedback"), you hereby grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, incorporate, and implement such Feedback without any obligation to you.

You acknowledge and agree that:

• We may implement any Feedback without providing compensation or credit
• We are under no obligation to implement or use any Feedback
• Feedback is provided voluntarily and at your own risk
• We may already be developing similar features or improvements

Unless explicitly agreed otherwise in writing, any Feedback you provide is non-confidential and may be freely used by us.

By providing Feedback, you waive any claims you may have against us relating to our use of such Feedback, including but not limited to claims of intellectual property infringement or compensation.

We may offer promotions, contests, sweepstakes, giveaways, or other promotional activities ("Promotions") from time to time.

Each Promotion will be governed by its own specific rules, which will be made available at the time of the Promotion. By participating in any Promotion, you agree to those specific rules in addition to these Terms.

Promotions may have additional eligibility requirements, including but not limited to age, location, and account status restrictions.

Any prizes awarded in Promotions will be described in the applicable rules. We reserve the right to substitute prizes of equal or greater value at our discretion.

Winners of Promotions are responsible for all applicable taxes and fees associated with prizes received.

All information provided through our Services, including Human Design charts, interpretations, AI responses, and educational materials, is for educational and entertainment purposes only. Our Services are not intended to provide:

• Medical or health advice
• Psychological or mental health treatment
• Financial or investment advice
• Legal advice
• Career or professional guidance

Our Services should not be used as a substitute for professional consultation. Always seek the advice of qualified professionals for specific concerns.

While we strive for accuracy in our chart calculations and content, we do not guarantee that all information is complete, accurate, or up-to-date. Human Design interpretations may vary among practitioners.

We are not responsible for any third-party content, links, or services referenced on our platform.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TPH BUSINESS CONSULTANCY SERVICES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability to you for any claims arising from or related to these Terms or your use of our Services shall not exceed the greater of: (a) the amounts you have paid to us in the twelve (12) months preceding the claim, or (b) PHP 5,000.

These limitations do not apply to: (a) liability arising from our gross negligence or willful misconduct, or (b) any liability that cannot be excluded or limited under applicable law.

The limitations of liability reflect the allocation of risk between us and you, and are an essential basis of the bargain between us.

You agree to indemnify, defend, and hold harmless TPH Business Consultancy Services, its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our Services
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Services will cease immediately.

We may suspend or terminate your account or access to our Services at any time, with or without cause, and with or without notice, including but not limited to:

• Violation of these Terms
• Conduct that we determine to be harmful to us or other users
• Suspected fraudulent or illegal activity
• Extended periods of inactivity
• Discontinuation of our Services

Upon termination:

• Your license to use the Services is immediately revoked
• We may delete your account and User Content
• You remain liable for any outstanding payments
• Provisions that should survive termination will remain in effect

We may retain certain data after termination as required by law or for legitimate business purposes, subject to our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.

Any disputes arising out of or related to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in La Union, Philippines.

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

We reserve the right to modify these Terms at any time at our sole discretion. Material changes will be effective upon posting to our Website or notifying you via email.

We will provide notice of material changes through one or more of the following methods:

• Email notification to your registered email address
• Prominent notice on our Website
• In-app notification
• Update to the "Last Updated" date at the top of these Terms

Your continued use of our Services after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of our Services.
