Mobile App Terms (EULA)

This End User License Agreement governs your use of the Total Human Design mobile apps for iOS and Android, including purchases made inside the app. It works alongside our Terms of Service and Privacy Policy.

These Mobile App Terms (this “EULA”) are a binding agreement between you and Total Human Design (“THD,” “we,” “us”) for your use of our mobile applications for Apple iOS and Google Android (the “App”), which you can download from www.totalhumandesign.com or the app stores. This EULA is between you and THD only — not Apple or Google.

The App is one way to access Total Human Design. Our Terms of Service and Privacy Policy still apply to everything you do in the App. This EULA adds the rules that are specific to the App and to purchases you make inside it. If anything here conflicts with the Terms of Service on an App-specific matter, this EULA controls for that matter.

1. Acceptance of this EULA

1.1 Agreement to These Terms

By downloading, installing, or using the App, you confirm that you have read and agree to this EULA, our Terms of Service, and our Privacy Policy. If you do not agree, do not install or use the App.

1.2 Who Can Use the App

You must be at least 13 years old to use the App, consistent with our Terms of Service. If you are under the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agreed to this EULA with you.

1.3 The Parties to this EULA

This EULA is concluded between you and THD only. Apple Inc. and Google LLC are not parties to this EULA and are not responsible for the App or its content — except for the limited rights described in Section 12 (Apple and Google as Third-Party Beneficiaries).

2. License to Use the App

We grant you the following license to use the App, subject to this EULA.

2.1 Scope of License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on any Apple- or Android-branded device that you own or control, for your own personal, non-commercial use. On Apple devices, this license is also governed by the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed to you, not sold.

2.2 Updates

We may release updates, upgrades, or new versions of the App. This EULA governs any update we provide, unless that update comes with its own terms, in which case those terms apply.

3. Things You May Not Do

Except where applicable law says otherwise, you agree not to:

  • Copy, modify, translate, or create derivative works of the App, except as the App normally allows;
  • Reverse engineer, decompile, or disassemble the App, or try to extract its source code;
  • Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App or your access to it;
  • Remove, hide, or alter any proprietary notices in the App;
  • Use the App in any way that breaks our Terms of Service, our Acceptable Use Policy, or the rules of the app store you downloaded it from.

4. Purchases, Subscriptions & Auto-Renewal

Please read this before you buy.

WHEN YOU BUY A SUBSCRIPTION IN THE APP, IT AUTOMATICALLY RENEWS FOR THE SAME PERIOD AND PRICE UNTIL YOU CANCEL. TO AVOID BEING CHARGED, YOU MUST CANCEL AT LEAST 24 HOURS BEFORE THE CURRENT PERIOD ENDS THROUGH YOUR APP STORE OR GOOGLE PLAY ACCOUNT. DELETING THE APP DOES NOT CANCEL YOUR SUBSCRIPTION.

4.1 How In-App Purchases Work

The App may offer auto-renewing subscriptions, one-time purchases (such as lifetime access), and consumable items (such as credit packs). When you buy inside the App, the purchase is processed and billed by Apple or Google, not by THD. The title, length, and price of each purchase are shown to you before you confirm, along with links to these terms and our Privacy Policy.

4.2 Auto-Renewing Subscriptions

Auto-renewing subscriptions continue and renew at the then-current price for the same period until you cancel. Your app store account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple App Store or Google Play account settings. Removing the App from your device does not cancel or refund a subscription.

4.3 Credits and Lifetime Purchases

Credits or tokens you buy through the App do not expire. A lifetime purchase is a one-time, non-consumable purchase tied to your account. You can use the App’s Restore Purchases option to restore a previous non-consumable or subscription purchase to a new device or after reinstalling.

4.4 Refunds and Cancellation

Because purchases in the App are billed by Apple or Google, refunds for those purchases are handled under their policies, not by THD directly. For purchases made on the website instead of in the App, our Refund Policy applies. Nothing here removes any statutory right you may have — for example, the right of consumers in the EU and UK to cancel a digital purchase within 14 days, unless you have started using the content and agreed to waive that right.

4.5 Price Changes

We may change subscription prices. If a price change affects your subscription, you will be notified and asked to agree before the new price takes effect, in line with app store rules. If you do not agree, you can cancel.

5. Educational and Entertainment Use Only

5.1 Not Professional Advice

The App and everything in it — including Human Design charts, interpretations, transit insights, and responses from our AI assistant — are provided for educational and entertainment purposes only. The App does not provide medical, psychological, mental-health, financial, legal, or other professional advice, and is not a substitute for a consultation with a qualified professional. Always seek the advice of a licensed professional for any question about your health, finances, or legal situation, and never disregard or delay professional advice because of something you read in the App.

5.2 Your Decisions Are Your Own

Any action you take, or choose not to take, based on the App is your own responsibility. To the fullest extent permitted by law, THD is not liable for decisions you make based on information from the App.

6. AI-Generated Content

6.1 How Our AI Works

Parts of the App, including SAGE, use artificial intelligence to generate responses. AI output is automatically generated, can be inaccurate or incomplete, and does not represent professional advice or the views of THD. Treat it as a starting point for reflection, not as fact.

6.2 Reporting AI Content

If the App produces content you find offensive, inappropriate, or harmful, you can report or flag it from within the App, or email us at [email protected]. We use these reports to improve content filtering and moderation.

6.3 What You Submit

You are responsible for what you type into the App. Do not submit other people’s sensitive personal information without their permission. As explained in our Privacy Policy, the prompts you send to AI features may be processed by third-party AI providers solely to generate your response.

7. Maintenance and Support

THD is solely responsible for providing any maintenance and support for the App. You can reach us at [email protected] or [email protected]. Apple and Google have no obligation whatsoever to provide any maintenance or support services for the App.

8. Warranty

8.1 Limited Warranty

The App is provided “as is” and “as available” to the fullest extent permitted by law, and our warranties are limited as described in our Terms of Service. THD, not Apple or Google, is responsible for any warranty that cannot be disclaimed.

8.2 Apple Refund of Purchase Price

On Apple devices, if the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation at all with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are THD’s responsibility.

9. Product Claims

THD, not Apple or Google, is responsible for addressing any claims you or any third party make relating to the App or your use of it, including: (a) product liability claims; (b) any claim that the App fails to meet a legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar law, including in connection with the App’s use of in-app purchase frameworks.

10. Intellectual Property Rights

All intellectual property rights in the App and its content belong to THD or its licensors, and are licensed — not sold — to you. If a third party claims that the App, or your use of it, infringes their intellectual property rights, THD, not Apple or Google, is solely responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by this EULA.

11. Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with any applicable third-party terms when using the App.

12. Apple and Google as Third-Party Beneficiaries

You acknowledge and agree that Apple and Apple’s subsidiaries — and, where you obtained the App from Google Play, Google and its affiliates — are third-party beneficiaries of this EULA. When you accept this EULA, Apple (and Google, as applicable) has the right, and is deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.

13. App Store Terms Also Apply

Your use of the App is also subject to the terms and rules of the app store you downloaded it from (the Apple App Store or Google Play), including their Usage Rules. Where those store rules conflict with this EULA about how you may use the App, the store rules apply to that conflict.

14. Governing Law and Disputes

This EULA is governed by, and disputes under it are resolved through, the same governing law and dispute-resolution process set out in Section 15 of our Terms of Service — including informal resolution first, binding individual arbitration, the class-action waiver, and the one-year time limit to bring claims. Those provisions are incorporated into this EULA by reference.

15. Changes to this EULA

We may update this EULA from time to time. If we make material changes, we will update the date above and, where appropriate, notify you in the App. Your continued use of the App after a change means you accept the updated EULA.
